We would rather operate without the need for defined terms and conditions but unfortunately we have no choice. If there is any term or condition that prevents you from dealing with us, we will look at it, and if  reasonable,  will confirm in writing its exclusion as part of our agreement.

There are two sections to our terms and conditions  

1. Design Terms & Conditions (i.e. we design a web site for you)

2. Services Terms, Conditions and Acceptable Use Policy. (i.e. hosting email etc)

Design Terms & Conditions.

Estimates
We will supply you with an estimate of the costs involved for the services you have requested before any work commences. Estimates will be based on site development for compatibility with all popular Windows and Linux based browsers in order to be the most cost effective balance between price compatibility. However if you require strict compatibility with any W3 standard (for example WAI-AAA) we would be happy to produce an alternative estimate based on any standard requested.

Content
All prices are based on images and text being supplied in a digital format. For example text should be supplied via email or as a notepad/wordpad/MS Word document. Images should be supplied ideally in one of the following formats TIFF/PNG/JPEG/GIF/EPS. If content is not supplied within the time allocated to the project sample text/images will be used instead. The full project cost is still payable however the required files can be supplied up to three months from completion of the project and will be included in the site without additional charge. The same applies for minor text changes which can be included without additional charge up to three months after completion of the work to allow for fine tuning.

Host-it logo
All sites designed or redesigned by host-it will contain a discrete link in either image or text form to the host-it web site displaying that it has been designed and/or hosted by host-it. A discount for the this link is included in all estimates given. If you do not require this link or it is subsequently removed an additional fee of £75 is payable.

Cancellation
If the agreement is cancelled after work has commenced, the client will be liable for any costs of purchases or labour made on the clients behalf incurred up to the date of cancellation. 

Intellectual property / trademark
The client unconditionally guarantees that any text, graphics, photographs, designs, trademarks, or other items supplied are owned by the client, or that the client has permission to use them from the rightful owner  and will indemnify Host-it from any claim or suit arising from the use of such items supplied by the client.

On receipt of cleared payment for all work produced, ownership and responsibility of all completed web graphics and source code are transferred to the client. Any software/technology used in the production of the site or original vector files used to produce any graphic content remain the property of host-it but can be purchased for an additional fee which is negotiable depending on the nature of the file.

Payment Policies
All accounts are set up on a pre-pay basis
, unless other terms have been agreed upon. Any account not settled within a 7 days of written or faxed notice or exceeding this time frame in any way is subject to suspension. No domain will be released to another hosting company until all outstanding amounts are paid. The customer is responsible for all money owed on the account from the time it was established to the time that the customer notifies Host-it in writing to request a termination of services. All payment is in Sterling. Where payment for services or design is overdue we reserve the right to charge interest at the rate of 10% per month, and also reserve the right to suspend service, with a re-connection fee of no less than £65 + vat. We may charge you a reasonable fee to cover our time and administration costs if any payment you are required to make is not honored by your bank or building society or credit card company, the current minimum charge is £45 + vat.

HM Customs and excise lunacy (Money Laundering Regulations 2003)
In line with the new HM Customs and excise 'High Value Dealer' guidelines quote: "If you can show us evidence that you have a clear policy of not accepting €15000 or more for a single transaction then you are not liable to register as an HVD". Failure to abide by this can land us with a fine of £5000 so please note that we have a clear policy (this is it) of not accepting cash payments of 15,000 or more. 14999 is however fine.

All offers and  prices quoted on our web site are subject to confirmation.

Services Terms, Conditions and Acceptable Use Policy.

Host-it provides Internet World Wide Web page hosting, Marketing, and Development. Host-it has certain legal and ethical responsibilities consistent with the use of its servers and equipment involved in these services.

Our general policy is to act as a provider of internet presence. We have specific ethical concerns regarding the use of its computers detailed below. Host-it reserves the right to suspend or cancel a customer's access to any or all services provided when we, in our sole discretion, decide that the account has been inappropriately used.

Hosting
All hosting services are for a minimum period of twelve months and renew automatically unless notice of cancellation is made in writing at least 24 hours prior to the renewal date. Hosting accounts are to be used by the primary individual/company only and cannot be used to resell, store or give away web-hosting services to other parties. This is defined as allowing a separate, third party to host content on the owner's web site however where content is within the primary site (eg banner ads, hit counters, news feeds etc) this is not a problem. If in doubt please ask us.

Specific Acceptable Use Policies

Server abuse
Any attempt to undermine or cause harm to a server, or customer, of
Host-it is strictly prohibited.

Unauthorized use of other people's accounts or computers
Host-it  will react to any use or attempted use of an Internet account or computer without the owner's authorisation. Such attempts include "Internet scamming" (tricking other people into releasing their passwords), password robbery, security hole scanning etc. Any unauthorized use of accounts or computers by a Host-it customer, whether or not the attacked account or computer belongs to Host-it, will result in action against the attacker. Possible actions by Host-it for any use or attempted use of an Internet account or computer without the owner's authorisation include warnings, account suspension or cancellation, and civil or criminal legal action, depending on the seriousness of the conduct.

Password Confidentiality
It is the responsibility of Host-it customers to keep the username(s)
and password(s) that Host-it supply, confidential. If a password is disclosed to a third party, any actions by the third party will be the responsibility of the account holder. Host-it reserves the right to terminate the account with immediate effect, without refund if, as a result of these actions, there is is a breach in the agreed terms and conditions.

Abuse General
Any customer who violates Host-it
Policies in abusing either space/site transfer by using more space than has been paid for, or using excessive bandwidth will be notified via email and given a maximum of 14 days to remedy the problem or pay an additional fee. If the problem is not resolved within the allotted 14 day period, the client hosting will be terminated and a refund paid by host-it for the unused period less an admin fee of £12. Host-it
reserves the right to exercise its sole discretion in determining what constitutes a violation of this provision.

Chat Rooms
We do not allow clients to install their own chat rooms, without approving it with the
Host-it Technical Team.

Email
To avoid unnecessary server traffic and maintain a high performance for our mail servers the minimum period for mail collection on a shared host-it mail server is 10 minutes. This will also allow sufficient time for normal server reboots to be performed with minimum errors. For dedicated servers there is no minimum period although normal bandwidth charges will apply.

Spam Filtering
All our panel based email accounts come with spam filtering (global and per user). Although the solution we offer is one of the most sophisticated of its type due to the nature of spam it is impossible to guarantee any level of filtering so this service is included but is on the basis that we make no warrantees regarding its performance.

Bulk Mail shots
No bulk email transmissions are permitted unless confirmed by host-it in writing. For the purpose of definition bulk email is classed as over 500 emails per week). All lists must be 'opt in' with a clear 'remove from list' option. This applies to all virtual and dedicated customers.

Lists should also be designed so that users need to confirm the request via an email confirmation (so only the person that receives the email could have subscribed). Also Information on when/how they opted in and if possible an IP address should be retained so this information can be supplied if a user disputes that they opted into a list.

IRC
We currently do not allow IRC or IRC bots to be operated on our servers.

Note: We believe in freedom of speech and expression, however, we will not risk a law suit or bad publicity for our company by hosting any "questionable material". Examples include but are not limited to:

  • Any site advocating illegal activities.
  • Certain radical or cult style groups.
  • Any site specifically slandering another person or organization or another cultural, religious, or ethnic group
  • Posting any Warez-related material -
    (pirated software, software evaluation cracks, etc.) on your web site.
  • Any other questionable material, as determined by Host-it

Support Area
Please note that the support area is for clients only. It is not an integral part of the services we supply. The information contained within this area is deemed to be correct, but all information and downloads are used at the clients own risk.
We reserve the right to limit access to this resource where necessary.

Payment Policies

The customer is responsible for all money owed on the account from the time it was established to the time that the customer notifies us in writing to request a termination of services. All payment is in Sterling. Where payment for services or design is overdue we reserve the right to charge interest at the rate of 10% per month, and also reserve the right to suspend service, with a re-connection fee of no less than £65 + vat. We may charge you a reasonable fee to cover our administration costs if any payment you are required to make is not honored by your bank or building society, credit card company or other payment method, the current minimum charge is £45 + vat.

Payment by credit/debit card. Where payment is made by this means the contract will be deemed to exist between ourselves and the card holder used in the initial transaction, however invoices may be made payable to the details you require for the purpose of vat or tax. For panel based hosting this can be set or amended via the panel by the customer as required.

Account Vetting
For security all accounts are vetted. This process may take up to 24 hours to complete and after this process if we find anything that we deem to be suspect with the transaction we reserve the right to reject the application and issue a refund.

Cancellation
Host-it reserves the right to cancel service at any time. Any violation of policies will not receive a refund if we institute our right of cancellation. Any violation which results in extra costs will be billed to the customer (i.e. transfer, space etc.).
In the case of cancellation of any product/service by the customer in order to ensure that the authorised person is the one making the request we reserve the right to ask that notice be made in writing and signed by either the person that originally ordered the service or someone authorised to make such request. For example in the case of a business a director and in the case of an individual a close relative or legal representative. Notices can be sent by post or faxed to the number/address shown on our web site.

Domain transfers
Transferring away - There are no fees at present to transfer a domain away from from us provided the correct information is supplied. It is up to us to supply a good service so you do not wish to leave!

We will complete the request exactly as instructed so if you are unsure please ask the new company for full instructions as the exact process can vary slightly between registrars and domain extensions. When transferring to us we give you full and accurate details of exactly what is needed and when you need to do it so when transferring away this is information you need to get from the receiving company. We will attempt to transfer the domain three times after which a fee of £25 + vat is chargeable to cover up to three additional attempts.

To ensure all requests are authorised they should be signed by the domain owner or a director (if a limited company) and faxed or posted to the address/facsimile number displayed on our Contact page. If you supply a return fax number or stamped addressed envelope we will send confirmation when your instructions have been completed.

The request must include the domain name(s) and the relevant information to effect the transfer (it is slightly different for some domain extensions - speak to your new company for details). The reason we ask for written confirmation is not only to protect us but also to help prevent a fraudulent application attempting to take control of your domain. We would however be sorry to see you go. :~(

Transfers are completed within seven working days of a request if you require transfer on a specific day we would be happy to do this for the following fees: weekday £15 per domain, weekend £25 per domain.

Transferring to us - Just let us know the domain(s) and we will advise you of the procedures that apply to your domain(s). Where necessary we will supply you with a simple form to complete with all the correct information that you can send to your existing hosting company. If we send the necessary information three times without success we will give you the option to either stop the process without any cost to you or pay a fee of £25 to cover three additional attempts (You should then try and reclaim this from your existing company) We would be happy to have your business. ;~) .

If you are transferring an international name space domain (ie .com/.net/.org) to us there is a fee of £15 + vat however this also includes an additional years renewal of the domain name.

Lawful Purpose
Host-it reserves the right to refuse service to anyone. Customers may only use
our server/s for lawful purpose. Transmission of any material in violation of any Federal, State or Local regulation is prohibited. This includes, but is not limited to copyrighted material, material legally judged to be threatening or obscene, and material protected by trade secrets. Host-it expressly forbids anyone from using its servers for the propagation, distribution, housing, processing, storing, or otherwise handling in any way which we deem to be objectionable. The designation of any materials as such described above is left entirely to the discretion of Host-it.

Indemnification
Customer agrees that it shall defend, indemnify, save and hold Host-it harmless from any and all demands, liabilities, losses, costs and claims, including reasonable legal fees asserted against Host-it, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Host-it against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Host-it server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from Host-it server.

Disclaimer
Host-it will not be responsible for any damages your business may suffer. Host-it makes no warranties of any kind, expressed or implied for services we provide. Host-it disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Host-it and its employees. Host-it
reserves the right to revise its policies at any time.

Competency
Use of our service's requires a certain level of knowledge in the use of Internet languages, protocols, and software. This level of knowledge varies depending on the anticipated use and desired content of Client's Web space by the Client.

The following examples are offered:

Web Publishing: requires knowledge of HTML, properly locating and linking documents, 'FTPing' documents, creating graphics, text, sound, image mapping, etc.

CGI-Scripts: requires a knowledge of the UNIX environment, TAR & GUNZIP commands, Perl, C Shell scripts, permissions, etc.

E-mail: a knowledge of POP3 service, mail forwarding, use of mail clients to receive mail, etc.

The Client agrees that he or she has necessary knowledge to create and utilise the service. Client agrees that it is not the responsibility of host-it internet solutions to provide this knowledge or Customer Support outside of the defined service.

News Letters.
As a customer of host-it you may recieve newsletters informing you of our news. However please note that this will only be from ourselves as your details are not passed to 3rd parties and the maximum number for each email address will be four per year although typically two is the average.

Excessive CPU/RAM Usage
Client agrees to take all responsibility for all programs including CGI scripts executed under their account. Programs that consume an excessive amount of CPU run time or Random Access Memory (RAM) are not permitted. Client agrees and understands that such excessive use can have an adverse effect on the performance of the webserver. Client agrees to accept responsibility for programs executed under his/her account, regardless of who authored the program. The use of cgi or html chat scripts or pages is strictly prohibited. We reserve the right to suspend accounts without notice to clients who violate these terms. Host-it has sole discretion over what constitutes excessive usage.

Relationship of parties under our reseller terms
The relationship between our selves and Reseller is that of vendor and vendee. They shall not be construed as being joint ventures, partnership, franchiser/franchisee, or employer/employee. This agreement is a commercial agreement between businesses, not a consumer agreement. Reseller has no authority, apparent or otherwise, to contract for or on behalf of host-it, or in any other way legally bind ourselves in any fashion, nor shall Reseller be authorized to make any representations about our company or its services other than to set forth host-it's responsibilities as outlined in this agreement.

Web sites must be accessed by the domain names supplied to us as the header addresses only. The practice of adding sub-directories for sites that are not directly linked to the default web sites business with domain pointing to these is strictly prohibited unless this has been agreed by host-it in writing.

We do not accept liability for any delay or failure to meet our obligations under the agreement that result from events beyond our reasonable control. This includes (but  not limited to) events that are within the control of third parties such as  suppliers, contractors and service suppliers.

All Sub-Networks, resellers and dedicated servers of Host-it must adhere to the above policies.

Services that relate to a public electronics communication services (PECS
) now require a code of practice dispute resolution.
